These Terms and Conditions (“Terms”) govern the use of the BondPay website and services (together, the “Services”), operated by BONDPAY (JERSEY) LIMITED (“BondPay”, “we”, “us”, or “our”). 1. About BondPay
1.1. BondPay provides payment processing and money transmission services to businesses and individuals, acting as a payment agent and facilitator between users and financial institutions.
1.2. BondPay does not provide banking services and is not a bank. All funds are held and transferred in accordance with applicable laws and through authorised financial partners.
2. Eligibility
2.1. You must:
- Be at least 18 years old;
- Have the legal capacity to enter into binding agreements; and
- Use the Services in compliance with all applicable laws and regulations.
2.2. We may refuse access to the Services at our discretion where eligibility requirements are not met.
3. Scope of Services
3.1. BondPay may provide, including but not limited to:
- Payment processing services;
- Money transmission and settlement services;
- Transaction reporting and related support services.
3.2. The availability of specific services may depend on your location, verification status, and applicable regulatory requirements.
4. User Obligations
4.1. You agree to:
- Provide accurate, complete, and up-to-date information;
- Use the Services only for lawful purposes;
- Not use the Services for fraudulent, illegal, or abusive activities;
- Comply with any onboarding, identity verification, or compliance checks required by BondPay.
4.2. You are responsible for maintaining the confidentiality of your account credentials.
5. Compliance, Verification, and Monitoring
To comply with anti-money laundering (AML), counter-terrorist financing (CTF), and other regulatory obligations, BondPay may:
- Request identity and business verification information;
- Monitor transactions;
- Suspend, restrict, or terminate Services where required by law or where suspicious activity is identified.
6. Fees
6.1. Fees applicable to the Services will be communicated separately or made available through the platform. Unless stated otherwise, all fees are exclusive of applicable taxes.
6.2. BondPay reserves the right to amend its fees with reasonable notice.
7. Suspension and Termination
7.1. We may suspend or terminate your access to the Services:
- If you breach these Terms;
- If required by law or a competent authority;
- Where we reasonably suspect unlawful or prohibited activity.
7.2. Termination does not affect any rights or obligations accrued prior to termination.
8. Limitation of Liability
8.1. To the maximum extent permitted by law:
- BondPay shall not be liable for indirect, incidental, or consequential losses;
- Our total liability arising out of or in connection with the Services shall be limited to the fees paid by you to BondPay in the preceding 12 months.
8.2. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Intellectual Property
All content, trademarks, and materials on the website are owned by or licensed to BondPay. You may not use them without prior written consent.
10. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on our website and become effective upon publication unless stated otherwise.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Jersey, without regard to conflict of law principles.
